The Statement of WorkshopWizard Terms & Conditions (“Statement”) governs and guides our relationship with users, members, advertisers, business and affiliate partners, and any others who interact with WorkshopWizard.com and its WorkshopWizard sub-domains including WorkshopWizardPro.com. By using or accessing WorkshopWizard and in consideration of providing access and services to you, you agree to the Statement.

Privacy

As stated in our Privacy Policy, we are highly concerned and cautious about safeguarding the privacy and confidentiality of our users. We utilize various measures that are designed to protect your privacy and to guard against anyone having or gaining unauthorized access, including electronic, physical and administrative devices and measures. We encourage you to carefully read the Privacy Policy and make informed decisions about the information that you submit and any information that you may include in advertisements and communications to our members, as well as to the general public who may look at certain public areas of the site.

Membership

To gain access to certain areas of the site, you must register as an individual, business, advertiser or vendor.

1.        Individuals are considered one person who is neither a business nor vendor who would like to use the site for personal purposes only.

2.       A business is any registered, licensed, legitimate sole proprietorship, partnership, corporation and other legal business entity legally registered in the United States of America to do business here or properly licensed and registered in the country where the business is located that wishes to use the site and/or conduct business on WorkshopWizard, subject to approval. A business may buy, advertise and promote its products and services; however, any payment by users for purchases of products or services of the business member must be properly and completely conducted and fulfilled at the business’s own site. Any reports from users or others of any violations of any kind will be cause for immediate termination of membership and legal action.

3.       Advertisers are registered business members who wish to register for the main purpose of placing advertisements on the site under rates, terms and conditions stated and specified online, within the WorkshopWizard Media Plan, and/or in classified advertisement policies on the site. Generally, advertisers are members whose companies wish to appeal and offer their products, services and announcements to the users of the WorkshopWizard sites and sub-domains, not participate in its other activities and services.

4.       Vendors are manufacturers and resellers who are selling their company’s products and/or services on the site are subject to all other terms and conditions of the site as specified here and in the Privacy Policy. A Vendor may buy, advertise and promote its products and services; however, any payment by users for purchases of products or services of the business member must be properly and completely conducted and fulfilled at the business’s own site. Any reports from users or others of any violations of any kind will be cause for immediate termination of membership and legal action. Vendors must be approved prior to conducting business on the site and must have their own web site(s) for processing payments and shipping goods.

Sharing Information and Advertising Content

We follow the strictest laws and guidelines covered by intellectual property rights, including by not limited to photographs, videos, logos, trademarks, copyrights, and any other intellectual property you may wish to share, submit for advertisement or information, publishing, and exhibition on the site. You own all of the Intellectual Property (IP) content that you upload, post, submit and include in advertising and content elsewhere on the site, your intellectual property rights are always paramount.

1.        For as long as your IP content is active on our site, you grant us permission to publish it on our site and you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license (“IP License”)  to use any IP content that you post on or in connection with WorkshopWizard. The IP License terminates when you remove or delete your IP content or deactivate your account. However, we will have no control over any content that has been shared with others and has not been deleted by others.

2.       When you delete IP content, it may remain in an inaccessible area of our systems that will be inaccessible to others.

3.       Please inform us should any of your IP content or rights become an issue or of question.

Safe Content

We need your help to keep the entire WorkshopWizard site and its community of users safe from any offensive, illegal and otherwise detrimental content. We will do our level best to diligently monitor content. Please do not hesitate to report any content that does not meet our policies and guidelines or is of a suspicious nature. For content and advertising submissions, please adhere to the following guidelines:

1.       Do not post any content that is hateful, pornographic, threatening, illegal, offensive, unlawful, or that contains profanity, nudity, or graphic or gratuitous violence. Do not post any content or advertising that violates anyone’s right or the law.

2.       Be kind and respectful to other users.

3.       Do not use this site for any unlawful, malicious, misleading, solicitous, discriminatory, or otherwise offensive and illegal.

4.       Do not even think about doing or do anything that could compromise the site, disable its functions, overburden, or otherwise perform illegal acts to jeopardize the functionality, readiness and availability of the site. Do not upload any viruses, spyware, spam, malicious code, or anything else that is illegal and improper and that will jeopardize the operation of the site and compromise the users and their privacy. In other words, hackers, nutcases, stay out and stay away!

5.       Do not attempt to circumvent the buy, sell, promote, and listing policies and procedures.

6.       Do not solicit users for purposes beyond the scope of the site and its programs and services.

7.       Do not develop or offer any contests, giveaways, sweepstakes, and promotions on the site, without the express review and approval in writing by WorkshopWizard management. Should we consent, you must take full responsibility to follow all other policies of WorkshopWizard and the applicable laws of the states, country and jurisdictions to which the offers are made.

8.       Do not violate the Terms and Conditions Policy of WorkshopWizard.

Payment Terms

1.       Generally, all payments for listings, services and advertising are due immediately and prior to start of ad, listing or service.

2.       Listing, advertising, and fees for services are non-refundable.

3.       Payments are processed through PayPal or the current payment processing site selected by WorkshopWizard management.  Requests for alternative payment methods must be addressed to admin@WorkshopWizard.com and may only be available to member corporations and other formal businesses, not individual members.

Sharing Links

1.       If you are interested in placing a link on your website, please contact us at admin@WorkshopWizard.com

2.       You may not use our name, logo, intellectual property or any content for any reason without the express written permission of WorkshopWizard.

3.       WorkshopWizard is not liable or responsible for use of any of external links within advertising, listings or content placed by its members, advertisers and business partners nor for any errors or omissions pertaining to them, directly or indirectly.

Technical Issues

1.       For store vendors and company advertisers, any questions or inquiries regarding technical settings, store settings, and errors should be directed to webmaster@WorkshopWizard.com.

Advertising

1.       Advertising includes ads, listings, product ads, banner ads,

2.       Advertisers are expected to submit advertising that is consistent with our Privacy Policies and Terms and Conditions.

3.       Your ads must comply with our advertising guidelines found in the current Media Kit and online advertising information.

4.       Ad placement and positioning are at our sole discretion. However, we will endeavor to make placements in your favor whenever possible and practicable. 

5.       Advertising payments are non –refundable.

6.       You are expected to pay in advance in accordance with our Payment Terms specified above and on the WorkshopWizard site. Our responsibility to post your advertising ends when your advertising period expires.

7.       We hereby state clearly that we reserve the right to reject or remove your ad at any time for any reason that violates our policies, terms, and conditions.

8.       We are not responsible for any impropriety of your advertising, nor are we legally liable for any errors, omissions, misrepresentations or other improper legal matters pertaining to your advertising.

9.       We reserve the right to reject any advertising that is offensive, illegal or otherwise improper or not in the best interest of the WorkshopWizard sites, our members and visitors.

10.    As an advertiser, you are responsible for ensuring that you are the authorized person to place the ads and to make payments by your company or employer.

11.    You agree that should we determine that you are in violation of any part of this statement of Terms and Conditions, we may hold you responsible for that violation.

Entire Agreement

This Statement constitutes the complete, final and exclusive embodiment of the entire agreement between WorkshopWizard and its members, visitors, advertisers and business partner with respect to the terms and conditions of the member and/or business relationship specified herein.  If you agree to this statement, you are doing so voluntarily and without reliance upon any promise, warranty or representation, written or oral, other than those expressly contained herein. This Statement supersedes any other such promises, warranties, representations or agreements. This Statement may be amended or modified at the sole discretion of an authorized representative of  WorkshopWizard and at that time registered members will receive notification of the availability of the revised Statement that is posted on the WorkshopWizard site(s).
